Terms and Conditions of DSguided

1. Conclusion of the contract

You can order from DSguided via our homepage. With your order, you submit a binding offer to conclude a legally valid purchase agreement. Immediately after completing the order, you will receive an automatically generated email with the order confirmation, which simultaneously represents the acceptance of the offer to conclude the purchase agreement.

2. PricesAll prices are inclusive of VAT and in Euro amounts. In addition come postage and shipping costs. For deliveries to non-EU countries, additional customs duties, taxes and fees apply.

3. Postage & shipping costs, please refer to our current postage and shipping costs from our shipping cost overview.

4. Cost agreement If you make use of your right of revocation, you have to bear the cost of the return if the residual value of the same shipment that you have paid does not exceed a value of 100, - Euro. Otherwise, the return is free of charge.

Withdrawal: You can revoke your contract within one month without giving reasons in writing (eg letter, fax, e-mail) or - if the case before the deadline - by returning the goods. The period begins after receipt of this instruction in writing, but not before receipt of the goods at the recipient (in the case of recurrent delivery of similar goods not before receipt of the first partial delivery) and not before fulfillment of our information obligations under Article 246 § 2 in conjunction with § 1 para 1 and 2 EGBGB as well as our obligations according to § 312e Abs. 1 Satz 1 BGB in connection with Article 246 § 3 EGBGB. To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient. The revocation must be sent to:

Consequences In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered. If you can not give us back the service received in whole or in part or only in a deteriorated condition, you may have to pay us compensation. For a deterioration caused by the intended use of the thing, you do not have to pay any compensation. Incidentally, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as your own property and refraining from doing anything that impairs its value. Transportable items are to be returned at our risk. You have to bear the costs of the return if the residual value of the same shipment you have paid does not exceed a value of 100, - €. Otherwise, the return is free of charge. Non-parcels are picked up at your place. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the thing, for us with their receipt. End of revocation.

6. Care
Please note the washing instructions, which you can find on the labels of the products. We do not accept damages due to incorrect cleaning.

7. Retention of title, offsetting; lien
Until full payment, all delivered goods remain the property of DSguided.

(1) For consumers, we reserve the ownership of the purchased item until full payment of the invoice amount. Are you an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or special fund under public law, we reserve the ownership of the object of sale until the settlement of all outstanding claims from the business relationship with the purchaser. The corresponding security rights are transferable to third parties.

(2) You are only entitled to set-off if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you have a right of retention only if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If the customer is in default of us with any payment obligations, all existing claims shall become due immediately.

8. Applicable law
For all disputes arising out of or on the basis of this agreement, German law applies, excluding the UN Sales Convention.

jurisdiction
The sole place of jurisdiction, if the purchaser is a merchant or legal entity domiciled or established in Germany, for all disputes arising from the purchase contract, is DSguided's registered office in Dreieich.

If the purchaser does not have a registered office or a branch in the Federal Republic of Germany, but in the territory of a member state of the European Union, the sole place of jurisdiction for all disputes arising from the contract of sale is DSguided in Dreieich.

9. Final provision
Should any provision of these General Terms and Conditions be ineffective, this shall not affect the validity of the remaining provisions.

11. As payment methods are prepayment transfer, Sofortüberweisung, PayPal, purchase on account, purchase on installments, direct debit and credit card payment available.

Debit:
By specifying the current account, you confirm that you are entitled to direct debit via the corresponding current account and will provide the required coverage. Return debit notes are associated with a high expenditure and costs for us. In the case of a return debit note (due to the lack of required coverage of the checking account, expiry of the current account or unauthorized opposition of the Account Holder), you authorize DSguided / Resul Cevik to submit the direct debit a second time for the payment due. In such a case you are obliged to pay the costs arising from the return debit. Further claims are reserved. You will be given the opportunity to prove that the return debit has resulted in lower or no costs. In view of the expense and the costs for return debit notes and to avoid the processing fee, we ask you in the case of a cancellation or a withdrawal from the purchase contract, a return or a complaint, the direct debit not to contradict. In such a case, after consultation with us, the repayment of the payment by remittance of the corresponding amount or by credit.

We do not belong to the group of companies obligated by law to participate in dispute resolution procedures and do not participate in dispute settlement proceedings before consumer arbitration boards.
